Terms of Service

These Terms of Service (the “Terms”) are the agreement between you and the operator of Gem TD (referred to here as “I”, “me”, or “the operator” — Gem TD is run by an individual developer, not a company). They cover both the game at play.gem-td.net and this site at gem-td.net (together, the “Service”).

Plain summary: Gem TD is free to play. Be reasonable, do not cheat or break it, and understand that a hobby project comes with no warranties. Optional cosmetic skins are sold separately and have their own terms. This summary is not a substitute for the full text below.

1. Acceptance of these Terms

By accessing or playing Gem TD, you agree to these Terms. If you do not agree, please do not use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms on your behalf.

2. Licence to play

I grant you a personal, non-exclusive, non-transferable, revocable licence to access and play Gem TD for your own private, non-commercial entertainment. This licence does not transfer any ownership of the game, its code, art, sounds, or other assets to you. All rights not expressly granted are reserved. Intellectual-property and takedown matters are covered in the Intellectual Property & DMCA policy.

3. No account required

Gem TD does not require you to register or sign in. Your progress, high scores, and settings are saved locally in your browser (via localStorage) and are not tied to an account on my servers. Clearing your browser storage, switching browsers, or switching devices will not carry that progress over. See the Privacy Policy and Cookie Policy for details.

4. Acceptable use

You agree to use the Service fairly and lawfully. In particular, you must not cheat, exploit bugs for unfair advantage, tamper with or reverse-engineer the game to cheat, disrupt the Service, or use it for anything illegal. The full rules are in the Acceptable Use Policy, which forms part of these Terms.

5. Virtual items and purchases

Gem TD offers optional cosmetic skins as digital purchases. Skins are cosmetic only — they do not affect gameplay, difficulty, or balance. Buying a skin grants a limited licence to use it in the game; it does not give you ownership and it has no monetary or real-world value. Purchases, pricing, and taxes are handled by a third-party payment processor. Full details are in Virtual Items & Payments, and your refund rights are in the Refund & Cancellation Policy.

6. Availability and changes to the game

Gem TD is a hobby project offered on a best-effort basis. I may add, change, suspend, or discontinue any part of the Service — including specific skins or features — at any time, with or without notice. I do not promise the Service will always be available, uninterrupted, or error-free.

7. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. See the Disclaimer for more. Nothing in these Terms removes any warranty or right that cannot be excluded under the mandatory consumer law that applies to you.

8. Limitation of liability

To the fullest extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of (or inability to use) the Service. Because Gem TD is provided free of charge (aside from optional cosmetic purchases), my total liability to you for any claim relating to the Service is limited to the amount you actually paid me, if any, in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.

9. Third-party links and services

The Service may link to third-party sites or rely on third-party providers (such as the payment processor or the host). I am not responsible for the content, policies, or practices of those third parties.

10. Termination

You may stop using the Service at any time. I may suspend or end your access to the Service (or to purchased entitlements) if you breach these Terms or the Acceptable Use Policy, or where necessary to protect the Service or comply with the law. Sections that by their nature should survive termination (including licence limits, disclaimers, liability limits, and governing law) will continue to apply.

11. Changes to these Terms

I may update these Terms from time to time. When I do, I will change the “Last updated” date at the top of this page. Material changes will be reflected here; continuing to use the Service after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-laws rules, and the courts of Spain will have jurisdiction — except where mandatory consumer law gives you the right to bring proceedings in, or rely on the protections of, the country where you live.
